This Terms of Service page is maintained by Flexibility in Flight, LLC to describe the rules, policies, and conditions for using our website and services.

These Terms of Service ("Terms") govern your access to and use of the Flexibility in Flight, LLC website ("Site") and any classes, workshops, parties, events, products, or services ("Services") offered by Flexibility in Flight, LLC ("Flexibility in Flight," "we," "us," or "our"). By visiting our Site, registering for a class, booking a party, or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

1. Services and Eligibility

Flexibility in Flight provides in-person aerial arts, pole fitness, bellydance, flexibility, yoga, and related fitness classes, workshops, private lessons, parties, and events for adults and, where specifically offered, minors. Class descriptions, schedules, pricing, and availability are subject to change.

By registering for a class or event, you represent that you are at least 18 years of age, or that you are the parent or legal guardian of a minor participant and have authority to register the minor. You further represent that you are in adequate physical and mental health to participate safely and that you have disclosed any relevant health conditions, injuries, or limitations to us as requested.

2. Registration and Accounts

To register for classes or purchase Services, you may need to provide accurate and complete information, including your name, contact information, and emergency contact details. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts, refuse service, or cancel registrations if we believe you have provided false information, violated these Terms, or engaged in conduct that could harm our students, staff, or business.

3. Class Policies and Attendance

a. Arrival and Late Entry

Please arrive a few minutes before your scheduled class to check in and prepare. Late arrivals may be denied entry for safety and warm-up reasons at the instructor's discretion. If you are more than 10 minutes late, we may not be able to admit you to class, and the class fee may still apply.

b. What to Wear

For safety, participants must wear appropriate clothing for the activity, as described on our What to Wear page and communicated at registration. Jewelry, lotions, oils, or other substances that may damage apparatus or create slipping hazards must be removed before class.

c. Health and Safety

Aerial arts, pole fitness, and dance activities involve physical exertion and inherent risk of injury. You must inform your instructor of any medical conditions, injuries, or physical limitations that may affect your participation. We reserve the right to modify or restrict participation for health and safety reasons.

d. Minors

Minors may participate only in age-appropriate classes and programs with a completed parent/guardian registration, liability waiver, and any required consent forms. A parent or legal guardian must remain reachable during the minor's participation unless otherwise stated for the specific program.

4. Cancellations, Rescheduling, and Refunds

Our cancellation and refund policies vary by service type. Current policies are posted on our Pricing page, communicated at checkout, and available upon request. Unless otherwise stated:

  • Class registrations and drop-in purchases are generally non-refundable but may be rescheduled or credited according to our published policy.
  • Workshops, private lessons, and party deposits may have specific cancellation deadlines; please review the terms shown at the time of booking.
  • No refunds or credits will be issued for no-shows or late cancellations outside the applicable policy window.
  • We reserve the right to cancel or reschedule classes, workshops, or events due to low enrollment, instructor illness, weather, or other circumstances. In such cases, we will provide credit, reschedule options, or a refund as appropriate.

5. Payments and Pricing

All prices are listed in U.S. dollars and are subject to change. Payment is required at the time of purchase unless otherwise arranged. We use third-party payment processors (such as Stripe, PayPal, or Square) to process transactions. By making a purchase, you agree to the terms and privacy policies of the applicable payment processor.

You agree to provide current, complete, and accurate billing information. We are not responsible for errors or delays caused by your payment method or third-party payment processors.

6. Liability Waiver and Assumption of Risk

Participation in aerial arts, pole fitness, dance, and fitness activities involves inherent risks, including but not limited to muscle strain, sprains, bruises, falls, and more serious injury. Before participating, you (or the parent/guardian of a minor participant) must sign our liability waiver and any required release forms.

To the fullest extent permitted by law, you assume all risks associated with your participation and agree that Flexibility in Flight, LLC, its owners, instructors, employees, and agents are not liable for any injury, loss, or damage arising from your participation, except for gross negligence or willful misconduct.

7. Intellectual Property

All content on our Site, including text, images, videos, logos, graphics, and class materials, is the property of Flexibility in Flight, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any content without our prior written permission.

If you submit photos, videos, testimonials, or other content to us (for example, for reviews or social media features), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, subject to any separate photo or media release you sign.

8. Prohibited Conduct

When using our Site or Services, you agree not to:

  • Use our Site or Services for any unlawful purpose or in violation of any applicable law.
  • Harass, threaten, intimidate, or discriminate against staff, instructors, students, or other participants.
  • Disrupt classes, events, or studio operations.
  • Attempt to gain unauthorized access to our systems, accounts, or data.
  • Record, photograph, or livestream classes, instructors, or other participants without their express consent.
  • Upload or transmit viruses, malware, or other harmful code.
  • Impersonate another person or misrepresent your identity or affiliation.

We reserve the right to remove any user content and to suspend or terminate access to our Site or Services for violations of these rules.

9. Third-Party Links and Platforms

Our Site may contain links to third-party websites, booking platforms, payment processors, or social media pages. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of third-party sites. Your use of third-party platforms is governed by their respective terms and policies.

10. Termination

We may suspend or terminate your access to our Site or Services at any time, with or without notice, for conduct that violates these Terms, is harmful to others, or is otherwise inappropriate. Upon termination, any outstanding obligations, including payment obligations, will survive.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or business operations. The updated Terms will be posted on this page with a revised "Effective Date." Your continued use of the Site or Services after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of our Site or Services shall be resolved in the state or federal courts located in Orange County, New York, and you consent to the jurisdiction of those courts.
